Terms and Conditions

ecocoffee Terms & Conditions

Please read these terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which ecocoffee make the products available to you ("these terms"). ecocoffee is referred to in these terms as “we” or “us”.

1. Prices
The prices on our website are the actual prices you will pay, subject to delivery charges where applicable. All prices are inclusive of any VAT payable unless otherwise stated.

2. Availability
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. Please note that we will not deliver substitute products should selected products be unavailable unless you agree that we should do so.

Your order will be fulfilled as soon as possible subject to availability of stock. It may be necessary to make more than one delivery. For example, if you were to make an order of 10 bags of a particular coffee and we have only 5 in stock, we will deliver 5 bags initially and the further 5 bags as soon as possible. We will always inform you if this applies. It will not result in an increase in the delivery charge which you agreed to pay when placing the order.

3. Agreement to Accept Order
There will be no contract (binding agreement) between you and us unless and until we have despatched to you the goods that you have ordered. At that time of despatch, we will charge you for the goods that you have ordered. Nothing that we do or say will amount to any acceptance of your offer/order until we have despatched your goods to you even if before that time your payment has been received by us or by Barclaycard Merchant Services or PayPal or other properly authorised agent on our behalf. At any point up until then, we may decline to supply products to you, and you may decline to buy products from us, and in either case without giving any reason. In such circumstances of cancellation by you of your order or non-acceptance of it by us, any payment received by us or by another person on our behalf will be refunded to you as soon as possible and without deduction.

At the moment that the goods are despatched to you (and not before), a contract will be made between you and us in accordance with these terms.

4. Delivery
Delivery will be made to the address and by the method specified by you when you place your order.

Guidance as to despatch and delivery times is given on the web site and will depend inter alia on stock availability. Items in stock will usually be despatched within 2 working days unless we inform you otherwise.

We will deliver your order to the main entrance of the delivery address. At your request at the time of delivery, the delivery person or agent may carry your order into the delivery address if it is safe and practical to do as you request.

Delivery agents may require the delivery to be signed for by an adult. If we attempt to deliver your order to the delivery address but there is no adult at the delivery address to accept delivery, the delivery person should leave notification of attempted delivery and their contact details. You will need to contact them (not us) to collect the package or to re-arrange delivery. If you do not make such arrangements with the delivery agent, they may return the package to us. In these circumstances we will notify you that the package has been returned to us. If you ask us to attempt delivery again, your liability to us will be limited to payment of a reasonable additional charge for the rearranged delivery. You shall have no liability to us for any inconvenience or loss which we may suffer due to such re-delivery being necessary.

If all your goods are not delivered to you within a reasonable time, and this is not due to circumstances in your control, we will attempt a new delivery at no further charge to you. In these circumstances our liability to you shall be limited to making reasonable arrangements for a new delivery and our bearing the cost of the new delivery. We shall have no liability to you for any inconvenience or loss which you may suffer due to such re-delivery being necessary.

5. Returns
We hope you will be happy with your purchase. However, should you feel it necessary to return an item, simply return it to us in the original packaging within 14 days of receipt and we will give you a refund on those products or replace the item, as you request.

Your statutory rights are not affected.

6. Cancellation
You can cancel or change any orders before despatch of goods to you by us. You can do this by email to orders@ecocoffee.co.uk or by fax to 01883 714128. Cancellations or changed orders made by telephone should be confirmed in writing or by email to avoid misunderstanding.

7. Payment
You can pay by any credit card or debit card which is accepted by Barclaycard Merchant Services or by PayPal. Your credit/debit card payment will be dealt with by Barclaycard Merchant Services or by PayPal on our behalf and your card details will not be taken or held by us. Such details will be encrypted by Barclaycard Merchant Services or by PayPal to minimise the possibility of unauthorised access or disclosure.

Our liability to you in connection with any order will not exceed the total price charged for the relevant items.

We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

8. General
These terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

If any of these terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms which will continue to be valid and enforceable to the fullest extent permitted by law.

Rising Prices Good News for Coffee Farmers

Coffee prices took a major dive in the second half of 2008 but are now rising again.  The long term projected uptrend is also good news.  Prices are now (September 2009) stabilising  around and above the 3$ per kilo mark, having plummeted to near 2.50$ per kilo in the early part of 2009.

Demand for Arabica beans is expected to grow at a faster pace than for Robusta.  The move by companies such as McDonald's, Maxwell House and Dunkin Doughnuts to use only Arabica beans for their coffee is indicative of a reversal in the trend towards cheaper robusta coffee from traditional Arabica varieties, which started in the 1990s.
